Title : “Article 368: Amending the Indian Constitution”

Speaker : Mr. Navroz Hormasji Seervai, Senior Counsel, Bombay High Court & Supreme Court of India.

Abstract:

Article 368 of the Indian Constitution lays down the powers of the Parliament to amend the Constitution, and the procedures to be followed therein. Amending powers of Parliament differ from its legislative powers. What does it mean to ‘amend’ the Constitution? The Article states that this power extends to ‘addition, variation or repeal any provision of this Constitution’. At the same time, the power to amend the Constitution is regulated by the necessity of judicial review and the doctrine of the ‘Basic Structure’ of the Constitution.
